Welcome to Pro Comfort Source HVAC Inc. These Terms of Service (“Terms”) govern your use of our website and the heating, ventilation, air conditioning, and related services provided by Pro Comfort Source HVAC Inc (“Pro Comfort Source,” “Company,” “we,” “us,” or “our”).
By using our website, contacting us to request service, scheduling an appointment, approving an estimate, or purchasing services or equipment from us, you agree to these Terms.

Pro Comfort Source provides residential and commercial HVAC services, which may include:
Air conditioning repair and service
Heating and furnace repair
HVAC system installation and replacement
Preventive maintenance and tune-ups
HVAC inspections and diagnostics
Thermostat installation and replacement
Indoor air quality services
Ductwork-related services
Other heating, cooling, ventilation, and related services
The specific scope of work for a customer will be determined by the applicable estimate, proposal, work order, invoice, service agreement, or other written agreement.
Any estimate or quote provided by Pro Comfort Source is based on the information and conditions reasonably available to us at the time the estimate is prepared.
During HVAC repairs or installations, previously unknown or concealed conditions may be discovered. These may include damaged electrical components, inaccessible equipment, deteriorated ductwork, code-related issues, structural conditions, water damage, asbestos or other hazardous materials, or problems caused by previous installations or repairs.
Additional work that falls outside the original scope may result in additional charges. Where customer authorization is required by applicable law, we will obtain that authorization before performing additional chargeable work.
Prices are subject to change until an estimate or proposal has been accepted in accordance with its terms.
Customers are responsible for providing accurate contact information and reasonable access to the property, HVAC equipment, electrical panels, thermostats, attic or crawlspace areas, and other locations necessary to perform the requested work.
Appointment times and arrival windows are estimates unless expressly stated otherwise. HVAC service may be affected by traffic, weather, emergency calls, availability of replacement parts, technician schedules, and circumstances outside our reasonable control.
We will make reasonable efforts to notify customers of significant scheduling changes.
The customer agrees to provide a reasonably safe working environment for our technicians and authorized personnel.
Customers should disclose known conditions that could affect the work, including electrical problems, water leaks, hazardous materials, restricted access, unsafe structures, aggressive animals, or other potentially dangerous conditions.
Pro Comfort Source may decline, suspend, or discontinue work when conditions at the property create an unreasonable safety risk or prevent the work from being properly performed.
By approving an estimate, proposal, work order, or service request, the customer authorizes Pro Comfort Source to perform the work described in that authorization.
The person approving the work represents that they are the property owner or otherwise have sufficient authority to authorize the requested services.
Payment terms will be stated on the applicable estimate, invoice, proposal, or service agreement.
Unless other arrangements have been agreed to in writing, payment is due according to the terms provided to the customer.
Customers are responsible for authorized charges for labor, equipment, materials, diagnostic services, permit fees, and other services included within the approved scope of work.
Past-due balances may be subject to lawful collection efforts and any fees or charges permitted by the applicable agreement and California law.
Replacement parts and HVAC equipment may be subject to manufacturer availability.
When an exact replacement is unavailable, we may recommend a reasonably comparable component or system. Any significant substitution affecting the customer's approved price or scope of work will be communicated before installation when required.
Manufacturer warranties are governed by the manufacturer's own warranty terms and conditions.
Any warranty provided directly by Pro Comfort Source will be described in the applicable estimate, invoice, proposal, service agreement, or warranty documentation.
HVAC equipment and parts may also carry separate manufacturer warranties.
Warranty coverage may not apply to problems resulting from misuse, neglect, unauthorized modifications or repairs, improper maintenance, abnormal electrical conditions, water damage, pests, structural problems, acts of nature, or other circumstances outside the Company's reasonable control, subject to applicable law and the specific warranty terms.
Nothing in these Terms is intended to exclude or limit warranties or consumer rights that cannot legally be excluded or limited under California law.
Pro Comfort Source is responsible for the work it agrees to perform, subject to the applicable service agreement and law.
We are not responsible for pre-existing defects or conditions unrelated to our work, including previously damaged equipment, defective wiring, plumbing problems, structural defects, mold, water intrusion, pest damage, or work previously performed by other contractors.
Discovery of an existing condition may require additional work and charges before the requested HVAC work can safely or properly be completed.
Certain HVAC installations, replacements, or modifications may require permits, inspections, testing, or other approvals.
Where applicable, responsibility for permits and related costs will be identified in the estimate, proposal, or agreement.
Code upgrades or modifications required by a governmental authority that were not reasonably identifiable before work began may result in additional work and charges, subject to customer authorization requirements.

Certain special-order equipment, custom materials, permits, or other project-specific expenses may be non-refundable where permitted by law and disclosed to the customer.
Any cancellation rights provided by California law remain unaffected by these Terms.
We attempt to keep the information on our website accurate and current. However, HVAC products, equipment specifications, pricing, promotions, rebates, incentives, financing programs, and service availability may change.
Information displayed on the website does not constitute a binding estimate or guarantee unless expressly identified as such.
Discounts, coupons, rebates, promotional offers, and special pricing may be subject to additional terms, expiration dates, equipment requirements, geographic limitations, or other restrictions.
Unless expressly stated otherwise, promotional offers may not be combined.
If financing options are made available, financing may be provided by an independent third-party lender or financing provider.
Approval, interest rates, payment terms, credit requirements, and other financing conditions are determined by the applicable financing provider.
Pro Comfort Source does not guarantee financing approval.
If you voluntarily provide your mobile telephone number and consent to receive text messages from Pro Comfort Source, we may send messages concerning appointment scheduling, technician arrival information, estimates, service updates, account information, follow-up communications, and other communications you have authorized.

You may opt out of marketing text messages at any time by following the opt-out instructions included in the applicable messages. Transactional communications may be handled differently where permitted by law.

These Terms, together with any applicable estimate, proposal, work order, invoice, service agreement, warranty, and Privacy Policy, constitute the applicable agreement between the customer and Pro Comfort Source concerning the matters they address.
If a signed written agreement contains terms that conflict with these general website Terms, the terms of the signed agreement will control with respect to the applicable service or project.
